Heineken advertisement in breach with French alcohol law

Beer brewer Heineken should withdraw all advertisements around the world championship rugby in France. A French court has decided this last Friday.

According to the court, sport events and alcohol advertisement do not go together. The advertisements of the official sponsor Heineken are in breach with the French legislation concerning alcohol advertisement. Heineken has got 48 hours to remove all publicity of the street. The company risks a fine of 5000 euro with every offence. In a response Heineken lets know that, according to the Dutch Press Agency (ANP), the legal decision is related to banners, which could be find exclusively in the streets of Paris. These advertisements will be removed within two days. Elsewhere in France the so-called banners are not distributed according to the spokesman of Heineken.

The lawsuit had been started by the French association against alcoholism and addiction, the A.N.P.A.A. The effectiveness of the French legislation concerning alcohol publicity becomes clear from its fast decision. Different from the situation in the Netherlands, this legislation has been fixed by law. In the Netherlands, there is no law which limits publicity but rules apply which have been established by the alcohol industry himself (self-regulation). If in the Netherlands a complaint is made against advertisement, it generally lasts several months before the Council of Advertisement pronounces a sentence. The publicity campaign has generally been expired for a long time. Moreover, a fine has never been imposed. Nevertheless, also the French legal control knows its limitations. According to the judicial pronouncement, Heineken is not seen responsible for being mentioned as an official sponsor on the web site of the WK, since it is composed by the office of the WK rugby. Regulating the Internet continues as an area with difficulty.
