Court: Youth club 't Waeske in Guttecoven responsible for the dead of a drunken teenager

25 September 2018

The Court of Limburg today sentenced youth club 't Waeske to a (partly conditional) fine. The court keeps 't Waeske responsible for the death of a 15-year-old boy.

According to the court, 't Waeske is not only responsible for making the 15-year-old boy drunk, but also for his death. If he had not been drunk, he would probably not have gone on the highway A2 and would not have been hit. The death of the boy is therefore reasonably attributable to 't Waeske.

The court condemned 't Waeske for violation of art. 252 of the Penal Code to a fine of € 15,000, half of which is conditional, with a trial period of 3 years.

In addition, the court imposes an unconditional fine of € 1,000 for violating art. 20, first paragraph, of the Alcohol Licensing and Catering Act, because 't Waeske served alcohol to a boy under the age of 18. If 't Waeske violates the Alcohol Licensing and Catering Act again in the next 3 years, the bar will be closed for a period of 6 months.
